By accessing and using SigPen ("Service"), you accept and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use our Service.

2. Description of Service

SigPen is an electronic signature platform that allows users to upload, edit, and electronically sign PDF documents. Our Service facilitates legally binding electronic signatures in compliance with the Electronic Signatures in Global and National Commerce Act (ESIGN Act) and applicable state laws.

3. Electronic Signature Consent

IMPORTANT: By using SigPen to create or sign electronic documents, you hereby consent to:

  • Conducting transactions using electronic signatures
  • Receiving documents and disclosures electronically
  • The legal validity and enforceability of electronic signatures
  • Electronic delivery of signed documents

You acknowledge that electronic signatures have the same legal force and effect as handwritten signatures under the ESIGN Act and applicable state electronic signature laws.

4. Account Registration and Security

  • You must provide accurate and complete registration information
  • You are responsible for maintaining the security of your account credentials
  • You agree to notify us immediately of any unauthorized access to your account
  • You are responsible for all activities under your account

5. Acceptable Use

You may not use SigPen to:

  • Upload or share illegal, fraudulent, or malicious content
  • Violate any applicable laws or regulations
  • Infringe on intellectual property rights
  • Attempt to gain unauthorized access to our systems
  • Use the Service for high-risk transactions requiring notarization

6. Subscription and Billing

  • Subscription plans: Starter ($9/month), Professional ($29/month), Business ($49/month)
  • All subscriptions include a 14-day free trial
  • Subscription fees are billed monthly in advance
  • All fees are non-refundable except as required by law
  • We may change pricing with 30 days notice
  • Your subscription automatically renews unless cancelled
  • Document limits apply based on your selected plan

7. Data and Privacy

  • We store your documents securely using industry-standard encryption
  • You retain ownership of your documents and data
  • We maintain audit trails as required by electronic signature laws

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SIGPEN SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

9. Service Availability

  • We strive for 99.9% uptime but do not guarantee uninterrupted service
  • Scheduled maintenance will be announced in advance when possible
  • We are not liable for downtime or service interruptions

10. Termination

  • You may cancel your subscription at any time
  • We may suspend or terminate accounts for Terms violations
  • Upon termination, you may download your documents for 30 days

11. Governing Law

These Terms are governed by the laws of the State of Ohio, United States. Any disputes shall be resolved in the courts of Ohio.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or through the Service. Continued use after changes constitutes acceptance of new Terms.
